Even when a judge decides provides visitation rights, the police do not enforce these judicial decisions. Often rather than uphold the judicial decisions, Japanes law enforcement will violate the judicial decision and often arrest the parent endeavoring to have his visitation right respected, inappropriately making false accusations that the foreign parent is being a stalker, or that he\/she is menacing the public order.<\/p>\n<p>According to European sources, given the absence of commitment from the Japanese administration, the French President of the European Union has invited the 27 members of the European Union to exert pressure on the Japanese government as this problem can potentially harm the image of Japan in the international community.<\/p>\n<p style=\"text-align: justify;\"><em>French<\/em><\/p>\n<p style=\"text-align: justify;\"><strong>Enfants binationaux et respect du droit de visite apr\u00e8s un jugement au Japon : une priorit\u00e9 de la Pr\u00e9sidence fran\u00e7aise pour les six prochains mois<\/strong><\/p>\n<p style=\"text-align: justify;\">Le 2 juillet 2008, la France a pr\u00e9sent\u00e9 ses priorit\u00e9s pour les six prochains mois de la pr\u00e9sidence fran\u00e7aise de l\u2019Union Europ\u00e9enne aux Ambassadeurs et Chefs de mission des 27 pays membres.<\/p>\n<p style=\"text-align: justify;\">De source europ\u00e9enne, en ce qui concerne le Japon, la Pr\u00e9sidence fran\u00e7aise a plac\u00e9 les affaires consulaires en mati\u00e8re de non-pr\u00e9sentation d\u2019enfant parmi ses quatre priorit\u00e9s,<\/p>\n<p style=\"text-align: justify;\">La France doit faire face, comme tous les autres pays de l\u2019Union europ\u00e9enne, les Etats-Unis et le Canada, au probl\u00e8me du respect du droit de visite apr\u00e8s un jugement de divorce dans le cas d\u2019enfants de couples binationaux en r\u00e9sidence au Japon.<\/p>\n<p style=\"text-align: justify;\">Plus d\u2019une vingtaine de ressortissants fran\u00e7ais voient actuellement leur droit de visite bafou\u00e9 malgr\u00e9 un jugement rendu au Japon. Quand bien m\u00eame ce droit de visite a \u00e9t\u00e9 l\u00e9gif\u00e9r\u00e9 par le juge des affaires familiales, il n\u2019est pas appliqu\u00e9 et la police n\u2019est d\u2019aucun recours, si ce n\u2019est au contraire pour interpeller le parent qui insiste pour le respect de ses droits au titre qu\u2019il trouble l\u2019ordre public.<\/p>\n<p style=\"text-align: justify;\">En l\u2019absence d\u2019un quelconque engagement de l\u2019administration japonaise \u00e0 r\u00e9soudre ces probl\u00e8mes, la Pr\u00e9sidence fran\u00e7aise a invit\u00e9, selon nos sources europ\u00e9ennes, les 27 pays membres de l\u2019Union Europ\u00e9enne \u00e0 exercer toute pression utile pour convaincre le gouvernement japonais que ce probl\u00e8me peut nuire \u00e0 l\u2019image du Japon sur la sc\u00e8ne internationale.<\/p>\n<p style=\"text-align: justify;\"><em>Source : <a href=\"http:\/\/afe-asie-nord.org\/?p=294\" target=\"_blank\">http:\/\/afe-asie-nord.org\/?p=294<\/a><\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>On the 2nd of July 2008, the French President of the European Union has announced its priorities for the forthcoming six months to the Ambassadors and Heads of Mission of the 27 member countries of the European Union.
